Czech 'Trumpist' Prime Minister-Elect Refuses to Sell Business Empire During Ethical Dispute

Andrej Babiš, the self-styled tycoon who secured victory in last month's parliamentary vote, has refused to offload his vast business interests, while asserting he will resolve a ethical dilemma that could prevent him from taking the position of prime minister.

Stance on Corporate Empire

Babiš, whose political movement came first in the autumn election but lacked a parliamentary majority, stated in a online statement that he will not sell his Agrofert group, which is active in agriculture, food processing, and chemical industries.

“I have consistently said I will never sell Agrofert. I have consistently stated I will address the conflict of interest in compliance with Czech and European laws,” Babiš commented. “This is not like selling a pastry in a bakery.”

President's Requirement

The Czech president, Petr Pavel, announced that the elderly political figure must clarify openly how he will eliminate conflicts of interest stemming from his corporate dealings before being appointed premier.

The national charter “explicitly requires the president to take into account the possible emergence of a conflict of interest and the possibilities for its resolution” when selecting government ministers, Pavel's office noted.

The president “wants it to be clear in what specific way Andrej Babiš will fulfil his statutory duties”, the statement said, noting that Pavel was ready to appoint Babiš as premier “immediately” once the issue was settled.

Business Operations and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert umbrella, function in the nation and other regional states, receiving millions of euros in domestic and European agricultural and other grants, as well as government deals.

Under Czech law, government ministers cannot obtaining state support or agreements. The anti-corruption organization Transparency International has indicated that to avoid a conflict of interest, Babiš must either sell, refuse public contracts, or not enter government.

Previous Term and Current Intentions

Babiš said he would “follow the laws” if appointed as premier, but did not want to explain how in advance because the matter was “an extremely sensitive and personal matter for me, and the media will always question me anyway”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over potential conflicts of interest. He placed his assets into fiduciary arrangements, while keeping certain control over them.

A judicial body and the European Commission both determined that this did not suffice. Babiš stated recently that he was again the sole owner of Agrofert and maintained he was “taking steps” to avoid a ethical problem, but declined to disclose details.

Coalition Agreement and International Consequences

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the far-right, pro-Russian SPD, which has called for a public vote on exiting the EU, and the Motorists for Themselves, which has primarily campaigned against the EU’s environmental policy.

The incoming administration, if approved, is likely to strengthen the populist bloc in the region and could challenge western support for Ukraine – even though Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to assure him of the nation's backing.

Pavel, who as head of state has a role for international relations, also requested that the coalition’s programme add a statement on the official stance on the conflict in Ukraine, with a pledge to meeting alliance duties.

The head of state has previously said he would not approve any ministerial nominees who might question the nation's international alliances, a condition that the far-right SPD has said it will satisfy by proposing non-partisan experts.
